1. Acceptance of Terms

By accessing and using BoothBoss ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

BoothBoss provides vendor event management tools including event tracking, sales management, inventory tracking, expense management, customer relationship management, and related features. The Service may be modified, updated, or discontinued at any time without notice.

3. Account Registration

To use BoothBoss, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your password and account
  • Be at least 13 years of age
  • Accept all responsibility for all activities that occur under your account

4. Subscription and Payment

BoothBoss offers both trial and paid subscription plans:

  • Trial accounts are valid for 10 days from the trial start date
  • Paid subscriptions are billed annually and automatically renew unless cancelled
  • You are responsible for all charges incurred under your account
  • Refunds are handled on a case-by-case basis at our discretion
  • We reserve the right to change subscription fees with 30 days notice

5. User Content and Data

You retain all rights to the data you enter into BoothBoss. By using the Service, you grant us the right to:

  • Store and process your data to provide the Service
  • Use aggregated, anonymized data for analytics and service improvement
  • Backup and secure your data

You are responsible for backing up your data. We are not liable for any loss of data.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to transmit viruses, malware, or other harmful code
  • Impersonate another person or misrepresent your affiliation
  • Scrape, copy, or reverse engineer any part of the Service
  • Share your account credentials with others

7. Third-Party Integrations

BoothBoss may integrate with third-party services (such as Google Calendar). Your use of these integrations is subject to the third party's terms of service and privacy policies. We are not responsible for any third-party services or their actions.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by BoothBoss and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOTHBOSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
